TRANSFERS: WIRES AND FOREIGN DRAFTS
All transfers and payments of funds will be made in accordance with law by New York Bay Remittance (NYBR), a trade name of Trans-Fast Remittance, LLC.  This transfer may be effected through independent paying agents such as foreign exchange houses, banks or communication companies which are unrelated and independent of NYBR.  NYBR will not be liable nor responsible for any delays in the transfer of funds resulting from inadequate, incomplete or inaccurate information furnished to NYBR by you nor caused by the unavailability of the recipient to receive or accept said funds at the location designated by you on the receipt.  (Collectively herein referred to as Buyer’s Fault.)

REFUND POLICY   
After 90 days claims and complaints will be accepted at our option.  In all situations where the failure to deliver funds was due to Buyer’s Fault and not through any fault of NYBR, you will be entitled to a refund within two weeks after NYBR has exhausted all reasonable efforts to locate the recipient.  The amount of said refund will be an amount which is lower of (a) the purchase price in US Dollars of the foreign currency at the time your purchase-price in US Dollars of the foreign currency at the time your purchase was placed with NYBR or (b) the amount in US Dollars received by NYBR in the conversion of the foreign currency on the date of refund as determined by the then existing rate of exchange.  You will not be entitled to any refunds of NYBR fees and charges.  In those situations where NYBR is unable to effect the transfer of funds due to no fault of yours or recipient, you will be entitled to receive an immediate full refund of the funds deposited by you with NYBR including any fees and charges advanced by you. 

STOP PAYMENT POLICY      
If you request NYBR to stop payment of the transfer, NYBR will make all reasonable attempts to do so but cannot guarantee nor be responsible if the transfer has been or is completed.  If NYBR is successful in stopping the transfer of funds you will be entitled to a refund determined as follows:
·         If funds were converted into foreign currency prior to your request to stop the transfer and said funds were not delivered to the recipient, the refund will be made to you in US Dollars received by NYBR in the conversion of the foreign currency on the date of refund as determined by the then rate of exchange.
·         If funds were not converted into the foreign currency prior to your request to stop the transfer and said funds were not delivered to the recipient, a refund of the purchase price in US Dollars of the foreign currency at the time your order was placed with NYBR will be made.

When you request stop payment of any transfer you will not be entitled to any refund of NYBR fees and charges.  In no event shall NYBR be liable in any manner for any special or consequential damages arising out of a transaction.
